Speeding; What Exactly is the Charge of Speeding?

Speeding is the accusation that a driver is operating a motor vehicle at rate in excess of either the posted speed limit or over the maximum allowable speed. While this definition seems overly simplistic, it is important to think about the concept of speeding and what exactly the government must prove in order to obtain a speeding conviction. The state must prove that the defendant was the operator of the vehicle and 2, the state has the burden of showing that the defendant's vehicle was traveling at rate not allowable by law at the time and place the state has accused the driver of speeding.
